PROSPEC MONTHLY DESIGN CONTEST — OFFICIAL RULES
Version 1.2 — Effective August 29, 2026
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE AT LEAST THIRTEEN (13) YEARS OLD AT THE TIME OF ENTRY. VOID OUTSIDE THE UNITED STATES AND WHERE PROHIBITED OR RESTRICTED BY LAW. THIS PROMOTION IS NOT SPONSORED, ENDORSED, OR ADMINISTERED BY, OR ASSOCIATED WITH, INSTAGRAM OR META PLATFORMS, INC.
1. Sponsor
The ProSpec Monthly Design Contest (the "Contest") is sponsored and administered by ProSpec Gloves LLC, a Virginia limited liability company, with its principal place of business at 1242 Reston Ave, Herndon, VA 20170 ("Sponsor," "ProSpec," "we," or "us"). Questions about the Contest or these Official Rules (the "Rules") may be directed to support@prospecgloves.com.
2. Agreement to these Rules
By submitting an entry, you (and, if you are under 18, your parent or legal guardian on your behalf) accept and agree to be bound by these Rules and by the decisions of Sponsor, which are final and binding in all matters relating to the Contest. The version number and effective date shown above identify the exact text you accept; that version is presented at entry and recorded with your consent. Sponsor will not change the Rules that apply to a Contest Cycle after that Cycle's entry window has opened, except where required by law; any revised Rules will carry a new version number and apply only to Contest Cycles published under that new version.
3. Eligibility
The Contest is open only to individuals who, at the time of entry:
1. are legal residents of one of the fifty (50) United States or the District of Columbia;
2. are at least thirteen (13) years old;
3. maintain an active Instagram account that they own and control, in compliance with Instagram's Terms of Use (which themselves require users to be at least 13); and
4. have access to the internet and a valid email address.
Entrants who are at least 13 but under 18 years old ("Minors") may enter only with the permission of a parent or legal guardian who has reviewed and agreed to these Rules on the Minor's behalf. A Minor who is selected as a winner must claim the prize through a parent or legal guardian as described in Section 11.
Individuals under 13 years old may not enter. The Contest entry system refuses under-13 entries outright and records nothing about the attempt; see Section 15.
Employees, officers, members, and contractors of Sponsor, and the immediate family members (spouse, parent, child, sibling) and household members of any of them, are not eligible to enter or win.
The Contest is void outside the fifty United States and the District of Columbia (including United States territories and possessions) and wherever prohibited or restricted by law.
4. Contest Cycles and schedule
The Contest runs in monthly cycles (each a "Contest Cycle" or "Cycle"). Each Contest Cycle is a separate and independent promotion with its own entry window, voting window, prizes, and winner. Sponsor expects to run one Cycle per month but is not obligated to run a Cycle in any given month and may adjust, skip, or discontinue Cycles at its discretion.
Each Cycle follows this general structure:
1. Entry window — entries are accepted;
2. Finalist selection — Sponsor reviews eligible entries and selects finalists;
3. Voting window — the public votes on the finalists as described in Section 9;
4. Verification and announcement — Sponsor verifies the results and announces the winner.
The specific opening and closing dates and times for each Cycle's entry window and voting window, and the expected announcement date, are published on the Contest page in the ProSpec Customizer (accessible from www.prospecgloves.com and at customize.prospecgloves.com) and/or on Sponsor's Instagram account before the Cycle opens. All times are Eastern Time (America/New_York). In the event of a conflict between published dates, the dates shown on the Contest page in the ProSpec Customizer control.
You may enter each monthly Contest Cycle in which you are eligible. The limit of one entry per person described in Section 5 applies per Cycle, not for the life of the Contest.
5. How to enter
To enter a Contest Cycle, complete all of the following during that Cycle's entry window:
1. Complete the entry form. Open the Contest page in the ProSpec Customizer and provide your date of birth, your email address, and your Instagram handle. You must verify the email address by entering the one-time verification code sent to it. You must also affirmatively accept these Rules; your acceptance, and the version of the Rules you accepted, are recorded.
2. Create your design. Use the ProSpec Customizer to design a custom glove. The design must be meaningfully customized: entries that are unmodified or trivially modified preset configurations, or that duplicate or nearly duplicate a preset or another entry, may be removed from consideration during screening.
3. Submit your entry. Use the Customizer's animation share flow to generate the short animated clip of your design and submit your entry. The clip and an image of your design are captured and attached to your entry automatically.
4. Follow and post. Complete the follow and Story requirements described in Section 6 before the entry window closes.
Limit: one (1) entry per person per Contest Cycle. This limit is enforced per email address and per Instagram handle. Attempting to exceed it — including by entering under multiple email addresses, multiple Instagram handles, or another person's identity — will disqualify all associated entries for that Cycle. Submitting the entry form more than once in a Cycle does not create additional entries.
An entry is complete only when the entry system confirms receipt of the submission. Entries generated by script, macro, bot, or any automated means, and entries on behalf of another person, are void.
By submitting the entry form you are also subscribing to ProSpec marketing emails, as stated plainly in Section 16.
6. Follow and Story requirements
As conditions of entry, you must, before the close of the Cycle's entry window:
1. Follow Sponsor's Instagram account, @prospec_gloves (the "Account"), from your own Instagram account — the same account whose handle you provided at entry — and remain a follower through the completion of winner verification for the Cycle; and
2. Post the clip to your Instagram Story from that same account, tagging (@-mentioning) @prospec_gloves in the Story.
Sponsor receives notice of your Story only through your @mention of the Account. Entries whose Story requirement cannot be confirmed by the close of the entry window may be removed from consideration during screening. If your Instagram account is private, or your Story mention is not received for any reason, Sponsor may request reasonable verification (for example, a screenshot of the posted Story); entries for which the requirement cannot be confirmed may be disqualified.
Instagram does not permit Sponsor to verify programmatically whether an account follows the Account. Sponsor therefore verifies the follow requirement manually, and only for the potential winner (and, if promotion under Section 11 occurs, for each subsequently promoted finalist), at the time of winner verification. A potential winner who is not following the Account at the time of winner verification will be disqualified and forfeit the prize, which will then be awarded as described in Section 11. Sponsor is not required to check, and does not represent that it checks, the follow status of any other entrant at any other time.
7. Content standards
Entries — including the design, any personalization text (names, numbers, custom embroidery text), and the associated Story post — must be your own work and must not:
1. include trademarks, logos, likenesses, or other intellectual property or rights of any third party, unless you hold the rights needed to grant the licenses in Section 14;
2. include hateful, harassing, threatening, defamatory, obscene, sexually explicit, or violent content, or content that promotes illegal activity, alcohol, tobacco, drugs, or weapons;
3. include personal information about any other person; or
4. otherwise violate any applicable law or Instagram's Terms of Use or Community Guidelines.
The Contest audience includes minors, and all entry content must be appropriate for a general audience. Every entry is screened by Sponsor before it can advance; entries that fail screening are excluded, and no entry is published or advanced without human review. Sponsor's determination that content violates this Section is final.
8. Screening and finalist selection
After the entry window closes (and on a rolling basis during it), Sponsor screens entries for eligibility and compliance with these Rules. Screening may remove, without limitation: entries whose Story requirement was not confirmed (Section 6); entries that are not meaningfully customized or that duplicate or nearly duplicate a preset configuration or another entry (Section 5); and entries held or failed under the content standards (Section 7).
From the entries that pass screening, Sponsor will select up to ten (10) finalists ("Finalists") in its sole discretion. In making its selection Sponsor may consider, among other things, creativity, originality, quality of execution, and suitability for publication, but no selection is automatic, no scoring formula is used or implied, and no entrant is entitled to advance regardless of any objective characteristic of the entry. If Sponsor receives an insufficient number of eligible entries in a Cycle, it may select fewer than ten Finalists or cancel the Cycle as described in Section 17. All screening and selection decisions are final.
Each Finalist is assigned a number from 1 to 10, and the Finalist designs are published, with their assigned numbers, in one or more posts on the Account (the "Finalist Post").
9. Public voting
The winner of each Cycle is determined by public vote on the Finalist Post, as follows:
1. How to vote. During the Cycle's voting window, vote by leaving a comment on the Finalist Post containing the number (1 through 10) of the Finalist you are voting for.
2. What counts as a vote. A comment registers a vote only if it contains a standalone whole number from 1 through 10 — that is, a number not embedded within other digits or characters. If a comment contains more than one standalone number from 1 through 10, the first such number in the comment is the vote it registers.
3. One vote per account. Each Instagram account may cast one (1) vote per Cycle. Only the account's first vote-registering comment counts; all of that account's later comments, and edits to earlier comments, are disregarded.
4. Voting window. Only votes cast during the Cycle's published voting window count. Comments posted before the window opens or after it closes are disregarded.
5. Vote integrity. Votes cast by bots, scripts, or other automated means; votes from fake, duplicate, purchased, or compromised accounts; and votes obtained through payment, exchange of value, or deception are void. Finalists may encourage their friends and followers to vote, but a Finalist who procures votes through any of the foregoing means may be disqualified. Comments that violate Section 7 may be removed or disregarded without registering a vote.
Sponsor tallies the votes and re-verifies the full tally after the voting window closes. Sponsor's verified tally is final.
10. Winner determination
The Finalist whose entry receives the highest number of valid votes in Sponsor's verified tally is the potential winner of the Cycle. The Finalist with the next-highest number of valid votes is the potential runner-up ("Runner-Up"), and the remaining Finalists are ranked in descending order of valid votes for purposes of Section 11. In the event of a tie at any position, Sponsor will select among the tied Finalists in its sole discretion, applying the considerations in Section 8.
All potential winners and promoted Finalists are subject to verification under Section 11. No entrant is a winner unless and until Sponsor completes verification and the prize claim is completed. Sponsor's determinations at every step are final.
11. Winner notification, verification, and claim
Sponsor will attempt to notify the potential winner by email, at the email address provided at entry, promptly after the verified tally is complete. The potential winner must respond and complete all of the claim requirements below within seven (7) days of Sponsor's first notification attempt. A potential winner who does not respond and complete the claim within that period, who declines the prize, or who is found ineligible or in violation of these Rules, forfeits the prize.
Claim requirements:
1. confirm eligibility under Section 3;
2. pass the manual follow verification described in Section 6;
3. provide the information needed to fulfill the prize: full name, mailing address within the fifty United States or the District of Columbia, and phone number if requested by Sponsor — this information is collected only at claim, not at entry (Section 15);
4. if the winner is a Minor, the claim must be completed by the Minor's parent or legal guardian, who must confirm their guardianship, provide the fulfillment information, and confirm consent to the Minor's participation and prize acceptance;
5. complete any tax documentation required by law as described in Section 13; and
6. if requested by Sponsor, sign and return a declaration of eligibility and a liability and publicity release (or, for a Minor, have the parent or legal guardian sign it) within the same seven (7) day period, except where prohibited by law.
If the potential winner forfeits or is disqualified, the prize is awarded to the Runner-Up, who then becomes the potential winner, subject to the same verification and claim requirements and the same seven (7) day response period. In that event the next-ranked Finalist under Section 10 becomes the potential Runner-Up. This process repeats down the verified ranking until the prize is claimed or Sponsor, in its reasonable discretion, determines that no eligible claimant remains in the Cycle.
The winner's Instagram handle and winning design will be announced on the Account following verification.
12. Prizes
Grand Prize (one per Cycle): one (1) custom glove, manufactured to the winner's contest-winning design, including standard shipping to the winner's verified mailing address within the fifty United States or the District of Columbia. The prize glove is manufactured in the leather specified in the winning design, provided that leather is offered in Sponsor's customizer at a base price of four hundred dollars ($400) or less as of the opening of the Cycle's entry window. Leathers offered above that price (for example, Samurai) are not available as part of the prize. If the winning design specifies a leather that is not available for the prize, the leather is adjusted to the winner's choice from the available leathers under the minimum-adjustments process below, and the design is otherwise manufactured as submitted. Approximate retail value ("ARV"): the retail price of the prize glove as configured, including standard shipping, as of the opening of the Cycle's entry window. If the winning design cannot be manufactured exactly as submitted (for example, because a material or component has become unavailable), Sponsor will work with the winner to make the minimum adjustments needed, or will substitute a prize of equal or greater value. Custom manufacturing takes time; manufacture and delivery are estimated at eight (8) weeks from claim completion.
Runner-Up Prize (one per Cycle): one (1) single-use promotional code for 30% off one custom glove order. The code expires thirty (30) days after it is issued and is void thereafter. ARV: thirty percent (30%) of the price of the order to which the code is applied. If the Runner-Up is promoted to winner under Section 11, the promoted entrant receives the Grand Prize in lieu of the Runner-Up Prize, and the Runner-Up Prize is awarded to the next-ranked Finalist per Section 11.
Prizes are non-transferable, and no cash substitution or prize substitution is permitted, except that Sponsor may substitute a prize of equal or greater value if a stated prize becomes unavailable. Prizes are awarded "as is." Any difference between the stated ARV and the actual value of a prize will not be awarded. The number of eligible entries and valid votes received determines the outcome of each Cycle; the Contest is a competition of design merit and public vote, and chance plays no role in winner selection.
13. Taxes
All federal, state, and local taxes on a prize, and all costs and expenses not expressly stated in Section 12 as included, are the sole responsibility of the winner (or, for a Minor, the winner's parent or legal guardian). Prize values are taxable income to the winner regardless of whether an information return is issued. Where required by applicable tax law — for example, if the aggregate value of prizes awarded by Sponsor to the same winner within a calendar year meets the IRS information-reporting threshold for prizes (currently $2,000 as of the effective date of these Rules) — the winner (or parent or legal guardian) must furnish a completed IRS Form W-9 or equivalent tax documentation as a condition of prize delivery, and Sponsor will issue a Form 1099-MISC as required.
14. License grants and use of entries
Your content. You retain any rights you hold in the original elements of your entry (for example, personalization text you authored). By entering, you represent and warrant that your entry is your own work, that it complies with Section 7, and that you have the right to grant the licenses below.
License to administer the Contest (all entrants). By entering, you grant Sponsor a non-exclusive, royalty-free, worldwide license to host, store, reproduce, adapt, and display your entry materials — your design configuration, design images, and animated clip (collectively, "Entry Materials") — for purposes of operating, administering, moderating, and judging the Contest during the Cycle.
License to publish Finalists. If your entry is selected as a Finalist, you additionally grant Sponsor a non-exclusive, royalty-free, worldwide license to publish your Entry Materials, with or without your Instagram handle, on the Account and Sponsor's other marketing channels in connection with the Cycle — including the Finalist Post, voting reminders, and winner announcements — and you agree that such posts may remain published after the Cycle ends.
Marketing archive license (top five). If your entry finishes the Cycle as the winner or as one of the runner-up entries — together, the top five entries of the Cycle — you additionally grant Sponsor a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to retain your Entry Materials indefinitely as part of Sponsor's disclosed marketing archive (Section 15) and to publish, reproduce, display, and adapt them, together with your Instagram handle, in Sponsor's marketing channels, indefinitely. This is the license that permits ProSpec to continue to publish the top five designs of each Cycle, credited to their creators' handles, after the Cycle ends.
Heightened protections for Minors (archive license). For an entrant who is a Minor at the time of entry, the marketing archive license above is subject to the following heightened protections: (a) the Minor, or the Minor's parent or legal guardian, may at any time request removal of the Minor's Instagram handle and any other identifying information from the marketing archive by contacting Sponsor as described in Section 22, and Sponsor will honor such a request without requiring a legal basis for it; following such a request, Sponsor may retain and continue to use the design content itself in de-identified form under the license above; and (b) Sponsor will not use a Minor's Entry Materials or Instagram handle in paid advertising placements without separate verifiable consent from the Minor's parent or legal guardian. These protections apply regardless of whether applicable law requires them.
Manufacture of the prize. The winner authorizes Sponsor to manufacture the winning design (with any adjustments under Section 12) in order to fulfill the prize.
Sponsor's property. The ProSpec Customizer, the glove models, materials, component libraries, fonts, trademarks, and all other ProSpec intellectual property made available in the Customizer remain Sponsor's sole property. You are granted only the limited right to use them within the Customizer to create and share your entry. No entrant acquires any right to manufacture, sell, or commercially exploit any design created in the Customizer by virtue of this Contest.
15. Privacy and data practices
This Section describes what Contest data Sponsor collects, why, and exactly how long it is kept. It is written to be enforceable as stated: Sponsor's deletion systems are built to these promises. Sponsor's general Privacy Policy, available at https://www.prospecgloves.com/policies/privacy-policy, applies to matters this Section does not address; if the two conflict with respect to Contest data, this Section controls.
Collected at entry: your email address (verified by one-time code), your date of birth, and your Instagram handle, together with your Entry Materials and limited technical signals used solely for fraud prevention (irreversibly hashed network and device identifiers and your browser's user-agent string). Your date of birth is used to confirm age eligibility and whether you are a Minor.
Collected at prize claim only: full name, mailing address, and, if requested by Sponsor, phone number — from the winner (or the winner's parent or legal guardian), and from a promoted or Runner-Up claimant, only. This information is never requested or collected at entry. Tax documentation is collected only where Section 13 requires it.
Voting data: votes are public comments on the Finalist Post. Sponsor processes the commenting account's handle, the comment text, and its timestamp to tally votes and verify the result.
Children under 13. The Contest is not directed to children under 13. The entry system refuses entry to anyone under 13 and writes no record of the attempt. Sponsor does not knowingly collect personal information from children under 13; if Sponsor learns that it has, it will delete it.
Retention — exactly what is kept, and for how long:
1. Marketing archive (top five). For each Cycle, the top five entries — the winner and the runner-up entries — are retained indefinitely as a disclosed marketing archive: the Entry Materials and the entrant's Instagram handle, as licensed in Section 14. The archive does not include email addresses, dates of birth, or claim information, which are deleted as described below.
2. Everything else. All other entry data for a Cycle — including all non-archived entries and their Entry Materials, all dates of birth, and all fraud-prevention signals — is deleted before the entry window of the next monthly Cycle opens. If winner verification or prize fulfillment for the Cycle is still in progress at that time, the data needed for that process is retained only as long as the process requires and is deleted promptly when it concludes.
3. Email addresses. Deleted on the same schedule as item 2, except the winner's email address (or the guardian's, for a Minor winner), which is retained until prize fulfillment completes and is then deleted.
4. Claim information. The winner's name, mailing address, phone number, and any guardian contact information collected at claim are retained until prize fulfillment completes and are then deleted, except records Sponsor is required by law to keep (for example, tax records under Section 13).
5. Voting data. Commenter handles and comment text held in Sponsor's systems are deleted on the same schedule as item 2; anonymized vote tallies are retained so that verified results remain auditable. (Comments on the Finalist Post itself remain on Instagram under Instagram's terms and your own account's controls.)
6. Backups. Residual copies in encrypted backups persist for up to seven (7) additional days beyond deletion, after which they are overwritten in the ordinary backup rotation.
Your choices. You may request deletion of your Contest data at any time by emailing support@prospecgloves.com from the email address you entered with. Deletion requested before a Cycle completes withdraws your entry from that Cycle. The marketing-archive retention in item 1 is subject to the license in Section 14; for entrants who are Minors, the heightened protections in Section 14 also apply, and for adult entrants the deletion rights below apply.
Deletion rights (adult entrants). An entrant who is eighteen (18) years of age or older may request deletion of their personal information at any time by contacting Sponsor as described in Section 22. Upon a verified request, Sponsor will delete the entrant's personal information, including an Instagram handle displayed with an archived entry under Section 14. Sponsor may retain the entry's design content in de-identified form under the Section 14 license, and may retain records Sponsor is required to keep for tax, legal, or audit purposes.
Who receives your data. Contest data is processed by Sponsor and its service providers (cloud hosting and storage, and transactional email delivery) solely to operate the Contest as described here. Sponsor does not sell Contest data. Your Story and your comments are on Instagram and governed by Instagram's own terms; you are providing your Contest entry information to Sponsor, not to Instagram.
16. Marketing communications
Entering the Contest subscribes you to ProSpec marketing emails. By submitting the entry form, you agree that Sponsor may send marketing and promotional emails to the email address you provide. This is a stated condition of entry, and we say it plainly: entering signs you up. Every marketing email includes an unsubscribe link; you may unsubscribe at any time, and unsubscribing does not affect your entry, your eligibility, or your chances of winning in any way. Marketing use of your email address ends no later than its deletion under Section 15, unless you separately subscribe to ProSpec communications outside the Contest.
17. General conditions
Sponsor reserves the right to disqualify any entrant who: provides false or misleading information; enters under multiple identities or attempts to exceed the entry limit; tampers or attempts to tamper with the entry or voting process; violates these Rules, Instagram's terms, or applicable law; or acts in a disruptive, abusive, or bad-faith manner in connection with the Contest. Sponsor further reserves the right to void votes and revoke finalist status obtained in violation of these Rules, and to pursue any remedies available at law.
If a Contest Cycle cannot run as planned for reasons beyond Sponsor's reasonable control — including fraud, technical failure, unavailability of Instagram, or any other cause that corrupts or impairs the administration, security, fairness, or integrity of the Cycle — Sponsor may suspend, modify, or cancel the Cycle. If a Cycle is canceled, Sponsor may, in its discretion, select the Cycle's winner from among the eligible, non-suspect entries received before cancellation, using the process in Sections 8 through 11 as nearly as practicable, or may cancel the Cycle without awarding prizes where the integrity failure prevents any fair award. Notice of any suspension, modification, or cancellation will be posted on the Contest page and/or the Account.
Sponsor is not responsible for: lost, late, incomplete, corrupted, or misdirected entries or votes; failures or malfunctions of hardware, software, networks, or transmission; unavailability of Instagram or of the entrant's account; or errors in Contest-related materials. If an entry is confirmed received but later cannot be processed due to such a failure, Sponsor's sole obligation is to permit re-entry during the same entry window where practicable.
If any provision of these Rules is held invalid or unenforceable, the remaining provisions remain in full force. Sponsor's failure to enforce any provision is not a waiver of it.
18. Release and limitation of liability
To the maximum extent permitted by law, by entering you (and, for a Minor, the Minor's parent or legal guardian) release and hold harmless Sponsor and its members, officers, employees, contractors, and agents (the "Released Parties") from and against any claim, liability, loss, or damage arising out of or relating to participation in the Contest, the posting of Contest content to Instagram, the use of your Entry Materials and Instagram handle as licensed in Section 14, or the acceptance, use, or inability to use any prize.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES' AGGREGATE LIABILITY TO ANY ENTRANT ARISING OUT OF OR RELATING TO THE CONTEST WILL NOT EXCEED THE APPROXIMATE RETAIL VALUE OF THE GRAND PRIZE, AND IN NO EVENT WILL THE RELEASED PARTIES BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES. Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you; in such jurisdictions, liability is limited to the fullest extent permitted by law. Nothing in these Rules excludes or limits liability that cannot be excluded or limited under applicable law.
19. Instagram and Meta non-affiliation
The Contest is in no way sponsored, endorsed, or administered by, or associated with, Instagram or Meta Platforms, Inc. By entering or voting, each entrant and participant completely and irrevocably releases Instagram and Meta Platforms, Inc. from any and all liability arising out of or in connection with the Contest. You understand that you are providing your information to Sponsor and not to Instagram or Meta. Any questions, comments, or complaints regarding the Contest must be directed to Sponsor, not to Instagram or Meta. Your use of Instagram in connection with the Contest remains subject to Instagram's own Terms of Use and Community Guidelines.
20. Disputes, governing law, and arbitration
These Rules and any dispute arising out of or relating to the Contest are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules.
Binding individual arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to the Contest or these Rules that cannot be resolved informally will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Fairfax County, Virginia (with the option to proceed by videoconference or on written submissions where the AAA rules allow). Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or equitable relief in court for infringement or misuse of intellectual property. For any matter properly before a court, the state and federal courts located in Fairfax County, Virginia and the United States District Court for the Eastern District of Virginia (Alexandria Division) have exclusive jurisdiction, and you consent to personal jurisdiction and venue there.
Class action waiver. To the maximum extent permitted by law, all disputes will be arbitrated or litigated only on an individual basis; neither you nor Sponsor may participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, with the remainder in arbitration.
21. Winner information and copies of these Rules
For the Instagram handle of the winner of any Contest Cycle, email support@prospecgloves.com with the subject line "Winners List," identifying the Cycle month, within sixty (60) days after that Cycle's announced winner date. These Rules are available at the URL published with each Contest Cycle and will be provided by email on request to support@prospecgloves.com.
